A pest report is one of the few maintenance calls that is simultaneously a practical problem, a health question, and a legal question. When a tenant reports mice, the landlord's first decision is not which trap to buy — it is working out whether this is the landlord's problem to fix, the tenant's, or both, and how quickly the law requires a response. Get that wrong and a £150 treatment can escalate into a council enforcement notice or a fitness-for-habitation claim.

Who Is Responsible: Landlord or Tenant?
There is no single statute that says "pests are the landlord's job" or "pests are the tenant's job." Responsibility follows from why the infestation exists, and in practice it resolves into three rules:
1. If the pests got in through a defect in the building, it is the landlord's responsibility. Gaps around pipework, failed airbricks, cracked drains, holes in the building fabric, deteriorated door seals — these are disrepair, and repairing them falls under the landlord's obligations in section 11 of the Landlord and Tenant Act 1985. An infestation that arrives through a structural route stays the landlord's problem until the route is closed, no matter how many treatments are paid for in the meantime.
2. If the infestation was present at the start of the tenancy, it is the landlord's responsibility. A property let with an active infestation is unlikely to meet the standard set by the Homes (Fitness for Human Habitation) Act 2018, which makes freedom from serious hazards — including pest infestation under the Housing Health and Safety Rating System (HHSRS) — an implied term of the tenancy. Dormant problems count here too: flea eggs left by a previous tenant's pets can lie inactive for months and hatch when a new tenant moves in.
3. If the infestation is caused by how the tenant lives in the property, responsibility shifts to the tenant. Exposed food waste, overflowing bins, poor hygiene, untreated pets — where these are the cause, the tenant carries responsibility for the conditions that created the problem, and a landlord may reasonably recharge treatment costs or claim against the deposit at the end of the tenancy, with evidence.
Most real cases involve some of each, and the practical division follows the cause: the landlord fixes the building — entry points, drainage, structural proofing — and instructs professional treatment where needed; the tenant maintains the hygiene and waste management that stops a population re-establishing.
In flats and terraced properties, pests rarely respect unit boundaries. Cockroaches, Pharaoh ants, and bedbugs all move between units through shared drainage runs, service voids, and party walls. Treating one flat in isolation gives temporary relief at best — a block-level problem needs the freeholder or managing agent involved, and treatment coordinated across affected units.
When it becomes a legal problem
Two enforcement routes matter to landlords. Under the Prevention of Damage by Pests Act 1949, councils can serve notice requiring a landowner to deal with rodent infestations, including carrying out structural proofing work, on a set timescale. Under the HHSRS, an Environmental Health Officer who inspects and finds a serious pest hazard can issue an improvement notice — and "domestic hygiene, pests and refuse" is one of the 29 assessed hazards. A tenant can also sue directly under the Fitness for Human Habitation Act without involving the council at all.
The practical takeaway: treat every pest report as a habitability matter requiring prompt investigation, not a routine maintenance request. The landlords who end up with enforcement notices are almost never the ones who responded slowly to a difficult infestation — they are the ones who did not respond at all.

Rats
The brown rat is responsible for the overwhelming majority of UK rodent infestations. Rats squeeze through gaps as small as 25mm, and a single breeding pair can produce over sixty young in a year. They transmit Weil's disease, salmonella, and E. coli through urine and droppings, and their gnawing damages timber, insulation, and electrical cables.
Signs: cigar-shaped droppings around 10mm long on regular travel routes (skirting boards, lofts, near waste storage), gnaw marks, dark greasy smears along walls, scratching in cavities at night, and outdoor burrow entrances near drain covers, tree roots, and paving edges.
The drainage rule: rats very often enter via defective drains — cracked runs, collapsed sections, poorly sealed access covers. An infestation with a drainage source cannot be resolved by surface baiting; the population simply replenishes from the sewer network. Where activity persists or recurs, a CCTV drain survey to find the access point, followed by repair, is the only lasting fix — and as a structural defect, it is the landlord's cost.
Treatment: rodenticide in tamper-resistant bait boxes checked every four to five days until uptake stops, or snap traps along walls where runs are visible, baited with peanut butter or chocolate. Releasing a live-trapped rat is illegal — cage-trapped animals must be humanely despatched. Persistent infestations need professional treatment, typically two to three visits.
Prevention is largely about the building and the garden: seal external gaps with steel mesh or wire wool (rats gnaw through filler and foam), repair drainage promptly, keep food waste in lidded bins, hang bird feeders rather than ground-feeding, and keep gardens clear of wood piles, overgrowth, and debris that provide harbourage. Councils have powers under the Prevention of Damage by Pests Act 1949 to require exactly this kind of proofing work — doing it proactively is cheaper than doing it under notice.
Mice
Mouse infestations develop fast — a single female can produce over sixty young a year — and mice contaminate food and surfaces with salmonella while gnawing cables and insulation. The house mouse is active indoors year-round; the field mouse typically appears in autumn and winter as outdoor food declines.
Signs: black rice-shaped droppings 3–6mm long along skirting and inside cupboards, scratching in walls or under floors at night, gnawed food packaging, and shredded nesting material in concealed spots.
Treatment: for minor infestations, DIY is a reasonable first response — traps baited with peanut butter or chocolate spread in cupboards and along skirting, checked daily, or rodenticide in tamper-resistant boxes. If bait is still being taken after three weeks, the infestation is bigger than DIY will resolve; instruct professional treatment.
The 6mm rule: mice fit through openings as small as six millimetres, so proofing has to be methodical — gaps under external doors, around pipe and cable penetrations, at airbricks, and along floor-level skirting joins, all sealed with rodent-proof materials. As with rats, structural proofing is the landlord's side of the bargain; food storage and kitchen hygiene are the tenant's.
Cockroaches
Cockroaches are the most serious insect pest a rental property can have. They spread the bacteria behind gastroenteritis, dysentery, and typhoid simply by moving across food and surfaces, and their droppings and shed skins trigger allergies and aggravate asthma. An active cockroach infestation is a strong candidate for failing the fitness-for-habitation standard, so prompt professional treatment is both a health necessity and sensible legal self-protection.
Species matter for finding the nest: the German cockroach (dark brown, ~17mm) favours warm, humid spots — behind fridges, around cookers, under sinks. The Oriental cockroach (near-black, ~25mm) prefers cooler, moist areas — basements, drains, ground-floor voids. Both are nocturnal; seeing cockroaches in daylight means the population has outgrown its harbourage and should be read as a sign of significant infestation. A sweet, musty odour in affected areas is another marker.
Treatment: DIY products rarely touch an established infestation. Professional treatment uses slow-acting gel or granule baits carried back to the harbourage, taking effect over a week or more, usually across two or more visits. A thorough clean before treatment matters — baits compete poorly against abundant food residue.
A cockroach problem in one flat within a block almost always indicates activity in the wider building — they travel through shared drainage, cable voids, and party-wall gaps. Notify the managing agent or freeholder immediately; treating a single unit in isolation will not resolve it.
Bedbugs
Bedbugs are not a public-health pest in the way rodents and cockroaches are, but their bites cause intense itching and the psychological toll of an active bedroom infestation is severe. Reports deserve the same urgency as any habitability issue — the longer bedbugs run untreated, the further they spread through the property and into adjacent units.
Signs: bites in clusters or lines on the neck, shoulders, arms and legs (reactions can take days to appear), and dark faecal spotting along mattress seams and edges. Adults are ~6mm, oval, flat, pale brown before feeding and reddish after. Heavy infestations produce a sweet, musty odour.
How they arrive: almost always carried in — on luggage, clothing, or second-hand furniture. They can also spread through party walls and floor voids from neighbouring units. They survive months without feeding, which is why second-hand mattresses and upholstered furniture should always be inspected, and why an infestation can surface in a property that has stood vacant.
Treatment: DIY is rarely successful — bedbugs hide where sprays do not reach. Professional heat treatment, chemical treatment, or both, often over multiple visits, is the reliable route, and it is the most expensive common pest treatment (£300–£1,000+ depending on severity and property size). Occupants support it by hot-washing and tumble-drying all bedding and clothing and reducing clutter around beds.
On responsibility: because bedbugs are introduced rather than building-related, a mid-tenancy infestation often traces to the occupants — but proving it is hard, and in blocks the source may genuinely be next door. The pragmatic approach for most landlords is to treat promptly and argue about cost allocation second; a spreading infestation costs more than the dispute is worth.
Fleas
Most fleas in rental properties are cat or dog fleas. Bites cluster around ankles and lower legs as small itchy red spots. The lifecycle is what makes fleas a landlord issue rather than purely a pet-owner issue: a female lays up to fifty eggs a day, not on the pet but into carpets, soft furnishings, and floorboard gaps — and those eggs can lie dormant for months, hatching when they sense the heat and vibration of a new occupant.
The void-period trap: this dormancy is why flea infestations regularly erupt in a property shortly after re-letting, even with no pets present — the new tenant's foot traffic triggers eggs left by the previous tenancy. A professional environmental flea treatment during the void, after any pet-owning tenancy, prevents this entirely and is far cheaper than treating a live infestation in an occupied property. Make it a standard changeover step for pet tenancies.
Treatment: the animal and the environment must be treated together — treating one without the other fails. Pets get vet-approved treatment first; then environmental insecticide across all floor surfaces and furniture undersides. Do not vacuum for ten days after treatment (it removes the product before it works on hatching larvae); after that, vacuum frequently to stimulate remaining eggs to hatch into the treated environment. Persistent cases go professional at £100–£250.
Responsibility is comparatively clean here: during a tenancy with pets, prevention and treatment sit with the tenant. Legacy infestations that surface after changeover are the landlord's to resolve — the incoming tenant did not cause them.
Ants
Ants split into two entirely different situations, and telling them apart is the whole game.
Black garden ants — the common case — are a nuisance, not a health risk. They nest outdoors in soil and under paving, and enter in trails toward food. Hygiene plus sealing entry points resolves most cases; where a problem persists, DIY insecticide aerosols into cracks and crevices, and insecticide dust at outdoor nest entrances, are appropriate and effective. The annual summer swarm of winged ants looks dramatic but lasts about forty-eight hours and is harmless.
Pharaoh ants are a genuine health hazard. Tiny (~2mm), pale yellow-brown, found only indoors in warm humid spots near boilers, heating runs, and sinks, they nest inside the building fabric — wall cavities, under floor insulation — and spread pathogenic bacteria. They are a particular problem in blocks, moving between flats through service voids.
Never treat suspected Pharaoh ants with DIY aerosol sprays. Spraying fragments the colony into multiple new nests across the property, multiplying the problem. Pharaoh ants need professional treatment with slow-acting gel baits carried back to the colony. If the ants are very small, pale, and appearing indoors near heat sources in winter, assume Pharaoh ants and call a professional.
Wasps
Wasps are seasonal — colonies build from scratch each spring, peak around August, and die off by late autumn. The default position for a wasp nest is to leave it alone: a nest in a garden tree, behind a shed, or in an unused corner will be dead by October at zero cost. Treatment is warranted only where the nest creates unavoidable risk — directly above an entrance, inside an accessible loft, or with its entry point beside a window that needs opening. For anyone in the household with a venom allergy, that calculus shifts toward treatment.
Two facts that save landlords money: wasp nests are never reused, so an old nest found during winter works or inspections needs no action at all — a nest with no wasps entering or exiting is inactive. And professional treatment of an active nest is one of the cheapest pest jobs there is (£50–£120, single visit), so for nests at height or in wall cavities there is little case for DIY heroics. Accessible nests can be self-treated at twilight with insecticide dust into the entry point, with protective clothing — but nests above head height should be left to professionals.
Bees
Bees are not pests, and pest controllers will almost never treat them — many will charge a call-out fee simply to identify the species and explain why. Populations are in national decline and the correct response to bees is nearly always to leave them alone or arrange rehoming, not treatment.
Honey bee swarms (typically May–June) usually move on within 48 hours; if one settles somewhere genuinely problematic, the British Beekeepers Association runs a directory of local swarm collectors who will remove and rehome the colony, usually free. Bumble bee nests are active for a single summer, die off by the end of September, and will not sting unless handled — leave them for the season. Masonry bees nesting in soft mortar cannot sting through skin and are a repointing item, not a pest problem: repoint after they emerge in late summer (never while eggs are sealed inside) and they will not return to that spot.
For landlords, the bee-shaped action is building maintenance — repointing deteriorating mortar and meshing airbricks stops masonry bees using the fabric in the first place.
Prevention Is a Maintenance Discipline
Almost everything above converges on the same conclusion: pest problems are mostly prevented by the unglamorous fabric maintenance landlords should be doing anyway. Sealed pipework penetrations, sound airbricks, repaired drainage, repointed mortar, clear gutters, managed gardens, secure bins. A pattern of pest call-outs across a property — or a portfolio — is usually a signal about deferred building maintenance, not bad luck.
That makes pest history worth tracking per property, the same way repair history is worth tracking: a property with three rodent treatments in two years has an unresolved entry route, and paying for a fourth treatment without a drain survey is money down the (probably cracked) drain.
